T Among the offenses that the Criminal Code regulates are the "Crimes of Danger", but the one that interests to the investigation is the Crime of Driving in State of Drunken that is within the crimes of abstract danger, these do not mention the protected legal goods In the criminal type, since the conduct that is performed is statistical or general to be able to produce injuries. However, the criminal law has a dual purpose in carrying out a process, since Article 92 of the Criminal Code establishes that along with the sentence provides for civil reparation, having to take into account that, although both are unified In the criminal process, this does not imply that they have the same nature. The civil remedy in the criminal process is nothing other than the civil responsibility attributed to the subject of the criminal offense, for which both must have the same purpose: to fully repair the damage. This is reinforced by the Penal Code itself, which establishes in Article 93 the extent of reparation, an extension that is immersed within the figure of civil liability. For this reason, the objectives pursued in the present investigation were to determine the legal basis by which civil reparation should not be imposed in the Conduct of Drunk Driving, and to determine the criteria that single-person criminal judges of the city of Cajamarca used to approve The sentences established in relation to civil reparation in the Conduct of Drunk Driving, when there is no damage caused by this crime. In this way, given that civil reparation can´t, under any circumstances, establish a criminal legal sanction, since it is based on a particular interest, it has a different nature from the penalty and for no reason can fulfill the functions of this, since civil reparation Derived from the crime focuses on the function of repairing the damage caused to the victim by the criminal action, in addition, for the determination of the amount of civil reparation must take into account the provisions of the Civil Code, it is clear that in this class of crimes No amount should be imposed as a result of civil reparation, since there is no objective damage that needs to be repaired, even the same convictions as this show this, since there is no clear motivation regarding civil reparation, since the only grounds They appreciate Articles 92 and 93 of the Criminal Code and legal bases 9 and 10 of Plenary Agreement No. 06-2006 / CJ-116, which are not sufficient criteria, as they do not break down each of the requirements that must be configured for taxation Of this figure.es_PE
