Principales factores que dificultan la formalización laboral en la empresa minera Mining Pacha Perú S.A.C, Otuzco – La Libertad, en el año 2016

Abstract

El desarrollo del presente trabajo de investigación titulado “PRINCIPALES FACTORES QUE DIFICULTAN LA FORMALIZACIÓN LABORAL EN LA EMPRESA MINERA MINING PACHA PERÚ S.A.C, OTUZCO – LA LIBERTAD, EN EL AÑO 2016,tiene como objetivo general determinar cuáles son los principales factores que dificultan la formalización laboral en la empresa minera Mining Pacha Perú S.A.C ubicada en el centro poblado de barrio negro de dicha ciudad, estableciendo el grado de informalidad laboral y sugiriendo recomendaciones específicas. Con la investigación, se evaluó la informalidad de la empresa MINERA MINING PACHA PERÚ S.A.C, para luego desarrollar los pasos pertinentes que comprenden a la metodología de investigación descriptiva. Los resultados muestran que los factores que asocian a la informalidad el bajo nivel de conocimiento sobre los procedimientos, requisitos y ventajas de la formalización tanto de los propietarios y trabajadores, la percepción de que los procedimientos y trámites son engorrosos y las altas tasas impositivas, la idiosincrasia cultural, la generación de mayores costos para la empresa, las discrepancias entre los socios, la falta de compromiso de los trabajadores, el bajo nivel de instrucción de ambas partes, la falta de presencia de las instituciones reguladoras y el bajo riesgo de ser detectados. Se demuestra que la formalización contribuye positivamente, puesto que su aplicación significa grandes beneficios laborales para sus trabajadores y mayor recaudación tributaria para el estado. Sin embargo, queda demostrado que la falta de atención por parte del gobierno local y gobierno central hacia las pequeñas empresas sigan no declarando todos sus ingresos netos, quedando en la informalidad laboral y tributaria.

The development of the present research project entitled: “MAIN FACTORS THAT HINDER THE LABOUR FORMALIZATION AT THE MINING COMPANY PACHA PERU SAC, OTUZCO – LA LIBERTAD, IN 2016”. Its general objective is, to determine which are the main factors that hinder the formalization of employment in the mining company Mining Pacha Peru S.A.C. Located at Barro Negro population center, in Otuzco, by stablishing the labour informality level and suggesting specific recommendations. With the investigation, the labour informality of the company MINERA MINING PACHA PERÚ S.A.C was evaluated, with the aim towards to develop the appropiated steps which comprise the descriptive research methodology. The results showed that the factors associated with labor informality are: Low levels of knowledge about the procedures, requirements and advantages of labor formalization from both owners and workers, the misperception that procedures and formalities are cumbersome, the government high tax rates, the people cultural idiosyncrasies, the high economic cost that represents for the company, the disagreements among the partners, the lack of commitment from its workers, the low level of education of both sides, the absence of regulation authorities, and the low risk of being detected. It shows that labour formalization represents a positive contribution, and its application will confer great labored benefits and improvement on its workers situation, it also represent an increase of the collections of taxes for the government. However, this lack of attention from local and central government to small and Mid-size businesses, results in bad practices such as tax evasion and labour informality.
