Seguridad jurídica y calificación de títulos del Registro de Propiedad Inmueble de Sunarp en Lima Metropolitana, 2021

Abstract

La presente tesis aborda el tema sobre “La seguridad jurídica y la calificación de títulos del registro de propiedad inmueble de Sunarp en Lima Metropolitana en el año 2021”; materia que se encuentra enmarcada en la rama del derecho notarial, así esta investigación tiene como objetivo principal determinar de qué manera la Superintendencia Nacional de los Registros Públicos brinda seguridad jurídica mediante la calificación de títulos del registro de propiedad inmueble en Lima Metropolitana durante el año 2021, asimismo, el presente trabajo se desarrolló mediante el enfoque cualitativo, dado que, se buscó demostrar la manera en que la institución pública de la Zona Registral N° IX de Sunarp cumplió o incumplió su rol respecto a garantizar la seguridad jurídica mediante la calificación de títulos en aras de salvaguardar el derecho de propiedad de los titulares propietarios en Lima Metropolitana durante el año 2021, de igual modo, el tipo de investigación que se utilizó para la presente tesis fue de tipo básico, dado que, se estudió en cómo se garantiza el interés jurídico de los propietarios del registro de propiedad inmueble y cómo el estado mediante las instituciones públicas cumplen su rol de garantizar la seguridad jurídica mediante la calificación de títulos, de la misma manera, se utilizó el diseño fenomenológico. Finalmente, se llegó a la conclusión que la Superintendencia Nacional de los Registros públicos si brinda seguridad jurídica mediante la calificación de títulos del registro de propiedad inmueble, pero de manera ineficaz, debido a la carga laboral de la institución y a la falta de registradores públicos para el área en específico, que puedan generar rapidez y eficacia en el cumplimiento de las funciones reguladas por el ordenamiento jurídico peruano y el reglamento de la Superintendencia Nacional de los Registros Públicos.

This thesis addresses the topic of "The legal certainty and the qualification of titles of the Sunarp real estate registry in Metropolitan Lima in the year 2021"; matter that is framed in the branch of notarial law, thus this research has as its main objective to determine how the National Superintendence of Public Registries provides legal security through the qualification of titles of the real estate registry in Metropolitan Lima during the year 2021 Likewise, the present work was developed through the qualitative approach, given that it sought to demonstrate the way in which the public institution of the Registry Zone No. IX of Sunarp fulfilled or failed to fulfill its role with respect to guaranteeing legal certainty through the qualification of titles in order to safeguard the property rights of the owner owners in Metropolitan Lima during the year 2021, in the same way, the type of research that was used for this thesis was basic, since it was studied how it is guaranteed the legal interest of the owners of the real estate registry and how the state through the public institutions fulfill their role of guaranteeing legal certainty through the qualification of titles, in the same way, the phenomenological design was used. Finally, it was concluded that the National Superintendence of Public Registries does provide legal certainty through the qualification of real property registry titles, but in an ineffective manner, due to the workload of the institution and the lack of public registrars to the specific area, which can generate speed and efficiency in the fulfillment of the functions regulated by the Peruvian legal system and the regulations of the National Superintendency of Public Registries.
