dc.description.abstractRESUMEN El presente trabajo, tiene por finalidad demostrar que todos los niños, niñas y adolescentes se les deben brindar u otorgar todos los derechos que la ley les ampara, así como; poder apreciar las diferencias y semejanzas que se encuentran en la legislación peruana respecto de la Adopción frente a la Ley de Acogimiento Familiar en el Perú. Hoy en día, podemos apreciar en el Perú que la Adopción puede obtener parecidos o semejantes derechos y obligaciones que la Ley de Acogimiento Familiar, pero, sin embargo; esta ley no cuenta con el mismo reconocimiento que la ley otorga a la Adopción para brindarles la facultad y potestad de adoptar a un menor de edad por un tiempo indeterminado y sin que deje de ser excepcional que es lo que si se exige en la ley mencionada, por el cual sería de vital importancia que estos cuenten con el respaldo jurídico suficiente y necesario en busca del sostenimiento, amor, cariño, protección, educación y formación que el menor requiere en casos que este se encuentre en situación de abandono y desamparo, así como su bienestar física como psicológica. Por eso lo que se busca es brindarle al menor de edad un hogar de familia, donde los hogares cuenten con la facultad de poder adoptar y brindar un hogar de amor y cuidado del menor en base a las normas, convenios internacionales, códigos del niño, niña y adolescente, etc. Por lo que pretendemos es que esta Ley de Acogimiento Familiar sea regulada de manera idónea y correcta por el sistema jurídico peruano en beneficio tanto el menor de edad, así como velar por su Interés. Podemos finalizar acotando que el principio primordial por parte del Estado es El Interés Superior del Niño y Adolescente, regulada en la legislación peruana y que como fin supremo señala que el menor y adolescente deben ser adoptadas por el Estado en amparo de todos sus derechos. Por ello la realización del presente trabajo es buscar proponer que se regulen estos derechos y obligaciones de la Ley de Acogimiento Familiar Perú.es_PE
dc.description.abstractABSTRACT This work developed aims to demonstrate all rights and obligations and the differences and similarities found in Peruvian law regarding the Adoption Act against Foster Care in Peru. Today in the current Peruvian reality Adoption in Peru generate and obtain similar or similar rights and obligations Foster Care Act but however this law does not have the same recognition as the law gives Adoption to give them the power and authority to adopt a minor for an indefinite time and without ceasing to be exceptional which is what if required by the said law by which it would be vital that they have the legal backing in search of support love care protection education and training that the child requires in cases that it is as abandonment and neglect as well as their welfare physical and psychological. So what is sought is to give the minor a family home where families have the power to adopt and provide a loving home and care for the child based on the standards international conventions codes of the child and adolescents etc. So we want is that this Act Foster Care is regulated in an appropriate way and correct by the Peruvian legal system to benefit both the minor and ensure their Interest. We can finish annotating the primary principle by the State is The Best Interest of the Child and Adolescent regulated under Peruvian law and supreme order states that the child and adolescent should be taken by the State under all their rights that the realization of this work seeks to propose that these rights and obligations of the Law on Foster Care Peru is regulated.es_PE
