Tratamiento penitenciario y resocialización de los internos reincidentes del Centro Penitenciario de Cajamarca.

Abstract

La presente tesis de investigación titulada “Tratamiento penitenciario y resocialización de los internos reincidentes del centro penitenciario de Cajamarca”, se ha desarrollado con el propósito de determina porque existe un gran porcentaje de internos reincidentes del centro penitenciario de Cajamarca que no se han resocializado, es decir, que no cumplen con los objetivos de la legislación sobre ejecución penal y con la función preventiva, protectora y resocializadora de la pena, incumpliendo de esta manera lo establecido en el artículo 139º inciso 22 de nuestro ordenamiento constitucional.

El objetivo general de la presente investigación es: determinar las causas del fracaso del tratamiento resocializador en internos reincidentes del penal de Cajamarca; y como objetivos específicos: determinar si el interno del Centro Penitenciario de Cajamarca recibe una asistencia psicológica, religiosa y laboral adecuada; determinar la resocialización del interno del Centro Penitenciario de Cajamarca mediante la asistencia psicológica, religiosa y laboral brindada; estudiar y analizar la finalidad de la pena referente a la resocialización del interno; describir las actividades que se realizan como parte del tratamiento resocializador; determinar la reincidencia de los internos del penal de Cajamarca.

El trabajo se ha desarrollado aplicando la metodología de la investigación científica de conformidad con los lineamientos establecidos por la Universidad. Para tal efecto se aplicaron las técnicas de la entrevista y encuestas. Con la información recogida mediante las técnicas e instrumentos se ha consolidado la información. La información obtenida se ha clasificado para compararse los datos reales con la hipótesis y los objetivos propuestos en la presente tesis de investigación.

Como resultado de la presente tesis se ha concluido que si la asistencia psicológica se sigue brindando con un psicólogo a cargo, si la asistencia laboral no brinda mejores talleres a los internos, y si no se incorpora la ayuda religiosa como asistencia, va a generar que los internos que egresen del penal vuelvan a delinquir dañando a la sociedad, y de esta manera no se dé cumplimiento al tratamiento resocializador del Estado peruano.

The general objective of the present investigation is: Determining the causes of the failure of the treatment re socialization in recidivistic inmates of the prison of Cajamarca; And like specific objectives: Determining if the intern of the Penitentiary Center of Cajamarca receives a psychological, religious and labor adequate help; Determining her re socialization of the intern of the Penitentiary Center of intervening Cajamarca the psychological, religious and labor offered help; Studying and analyzing the purpose of the grief relative to her re the intern's socialization; Describing the activities that are accomplished as part of the treatment re socialization; Determining the recurrence of the inmates of the prison of Cajamarca.

The job has developed applying the methodology of the scientific investigation in accordance with the guidelines established by the University. For such effect the techniques of the interview and opinion polls were applicable. With the information picked up by means of the techniques and the information has consolidated instruments itself. The obtained information has classified for to compare the real data with the hypothesis and the objectives proposed in the present fact-finding thesis.

As a result of the present thesis one has come to an end that if the psychological help ensues offering to with a psychologist position, if the labor help does not offer the inmates better workshops, and if the religious help like help is not incorporated, he is going to be created to that the inmates that graduate from the prison commit a crime again damaging the society, and this way do not give fulfillment to the treatment the Peruvian State's re socialization.
