El diagnóstico genético preimplantacional y el derecho a la no discriminación del embrión ex útero en el Perú

Abstract

La presente investigación de tesis realiza un análisis respecto a la posible discriminación que recae sobre el embrión ex útero debido a los últimos avances de la ciencia en cuanto a reproducción asistida y genética, en este caso en específico, debido al diagnóstico genético preimplantacional. El marco teórico se divide en cuatro sub capítulos, teniendo como primer sub capítulo las teorías del origen de la vida humana desde el aspecto biológico y científico; así como se busca definir al embrión ex útero y la relación que tiene con la persona humana luego, como segundo sub capítulo, se desarrolla las técnicas de reproducción asistida; posteriormente en el tercer sub capítulo se desarrollan los derechos que le asisten al embrión ex útero y se indaga en cuanto al diagnóstico genético preimplantacional desde una óptica de la bioética; finalmente, en el cuarto sub capítulo se realiza un análisis comparado entre los países de Chile, Argentina y España. A través de las entrevistas practicadas a expertos nacionales e internacionales en bioética y derecho, contrastados con el amplio análisis doctrinario efectuado respecto al diagnóstico genético preimplantacional y al embrión ex útero, se arriba a un mejor entendimiento del hecho planteado en el problema de investigación, siendo factible probar la hipótesis planteada.

The present investigation makes an analysis regarding the possible discrimination that falls on the ex uterus embryo due to the latest advances in assisted reproductive science and genetics, in this specific case, due to the preimplantacional genetic diagnosis. The theoretical framework chapter is divided into four sub-chapters, having as the first sub- chapter, the scientific development of assisted reproduction techniques; Then, as the second sub-chapter, theories of the origin of human life are developed from the biological aspect, as well as the definition of the ex uterus embryo and its relationship with the human person; Later in the third sub-chapter the rights that assist the ex uterus embryo are developed and the preimplantational genetic diagnosis is approached from a bioethical perspective; Finally, in the fourth sub-chapter a comparative analysis is carried out between Chile, Argentina and Spain. Through the interviews conducted with national and international experts in bioethics, contrasted with the extensive doctrinal analysis carried out regarding the preimplantation genetic diagnosis and the ex uterus embryo, a better understanding of the fact raised in the research problem is made, being feasible to prove the proposed hypothesis.
