Compliance laboral y la responsabilidad civil objetiva del empleador en prevención de riesgos laborales

Abstract

El presente trabajo de investigación realizado en Lima Metropolitana trata acerca de la responsabilidad civil objetiva del empleador en prevención de riesgos laborales cuyo objetivo principal fue buscar la relación con el compliance laboral. Se utilizó una metodología cualitativa con un diseño descriptivo correlacional y se emplearon entrevistas a expertos, así como el análisis documental con el uso de los instrumentos de fichajes para la recolección y análisis de datos, obteniendo como resultado que la responsabilidad civil objetiva del empleador en prevención de riesgos laborales está íntegramente correlacionada con el compliance laboral, siendo esta la única institución jurídica que permitirá al empleador diligente alcanzar su deber de prevención y de protección consiguiendo una atenuación o exoneración de la responsabilidad civil derivada de un accidente de trabajo.

The present research work carried out in Metropolitan Lima deals with the objective civil liability of the employer in the prevention of occupational risks whose main objective was to seek the relationship with labour compliance. A qualitative methodology was used with a correlational descriptive design and interviews with experts were used, as well as documentary analysis with the use of the registration instruments for the collection and analysis of data, obtaining as a result that the objective civil liability of the employer in the prevention of occupational risks is fully correlated with labour compliance, this being the only legal institution that will allow the diligent employer to achieve its duty of prevention and protection, obtaining an attenuation or exoneration of the civil responsibility derived from an accident at work.
