Eficacia del proceso inmediato en el delito de omisión a la asistencia familiar, en el Juzgado de Paz Letrado e Investigación Preparatoria de Tembladera, años 2017 - 2018

Abstract

La omisión a la asistencia familiar es un problema relevante que afronta la sociedad actual, ante esto el Estado cumpliendo su función protectora y garantista del derecho a la alimentación de los niños, organiza la respuesta del sistema penal, basado en criterios de razonabilidad y eficiencia, expidiendo y aplicando el Decreto Legislativo Nº 1194, con el cual se incluye el delito antes mencionado en la vía del proceso inmediato. Frente a esta coyuntura, este estudio buscó determinar la eficacia jurídica del proceso inmediato en el delito de omisión a la asistencia familiar en el Juzgado de Paz Letrado e Investigación Preparatoria de Tembladera, años 2017 - 2018. Considerando la característica descriptiva de la investigación, se determinó una muestra de 27 casos en el año 2017 y 25 casos el 2018, construyendo y validando la guía de análisis documental utilizada para la recolección de datos. Producto del análisis de resultados se obtiene que del total de casos atendidos (52) en los dos años estudiados, 32 fueron derivados al Juzgado de Contumazá, 15 se acogieron al Principio de Oportunidad y 05 a la terminación anticipada del proceso. Por ello se afirma que el proceso inmediato es eficaz jurídicamente para los casos de omisión a la asistencia familiar.

The omission of family assistance is a relevant problem faced by today's society, before this the State fulfilling its protective and guaranteeing function of the right to food of children, organizes the response of the penal system, based on criteria of reasonableness and efficiency, issuing and applying Legislative Decree No. 1194, which includes the aforementioned crime in the immediate process. Faced with this situation, this study sought to determine the legal effectiveness of the immediate process in the crime of omission of family assistance in the Tembladera Law Court and Preparatory Investigation, years 2017 - 2018. Considering the descriptive characteristic of the investigation, it was determined a sample of 27 cases in 2017 and 25 cases in 2018, building and validating the document analysis guide used for data collection. As a result of the analysis of the results, it is obtained that of the total of cases attended (52) in the two years studied, 32 were referred to the Court of Contumazá, 15 accepted the Principle of Opportunity and 05 to the early termination of the process. For this reason, it is affirmed that the immediate process is legally effective for cases of omission of family assistance.
