Violencia psicológica hacia la mujer y su aplicación penal en el Distrito Judicial de Lima Norte en el periodo 2020

Abstract

El trabajo de investigación tiene relación con un tema de actualidad, cuya principal víctima es la mujer, si bien existe varios tipos de violencia del que se ven afectadas, la violencia psicológica es una de las situaciones que más cuestionamiento ha tenido, esto a razón de que normativa vigente que regula dicho acto ilícito no satisface las expectativas que se requiere para contrarrestar dicha violencia, la cual ha generado cierto malestar, no solo en aquello quienes son víctimas, sino en los operadores jurídicos. Es así que el objetivo del trabajo consiste en determinar cuáles son los problemas que limitan la correcta aplicación del delito de violencia psicológica en el Distrito Fiscal de Lima Norte, para ello se ha visto conveniente enfocar la investigación al modelo cuantitativo con diseño descriptivo – explicativo, para ello se ha visto conveniente llevar a cabo la técnica de encuestas, cuyo cuestionario han sido dirigido hacia los operadores jurídicos a fin de conocer sus impresiones frente al tema a investigar, teniendo como resultado principal que la norma penal que regula la violencia psicológica tiene problemas de estructuración y por ende de interpretación, lo que genera impunidad en estos tipos de casos. Finalmente, como conclusión relevante se ha arribado a que se advierte deficiencias estructurales de la norma penal, falta de capación de los operadores jurídicos, generar unidad de criterios y que las pericias psicológicas emitidas por los especialistas no cumplen los parámetros establecidos para un pronunciamiento oportuno y eficaz.

The research work is related to a current issue, whose main victim is women, although there are several types of violence that are affected, psychological violence is one of the situations that has had the most question, this at the rate of that current regulations that regulate said illegal act do not meet the expectations required to counteract said violence, which has generated some discomfort, not only in those who are victims, but also in legal operators. Thus, the objective of the work is to determine what are the problems that limit the correct application of the crime of psychological violence in the North Lima Fiscal District, for this it has been seen convenient to focus the investigation on the quantitative model with descriptive-explanatory design, For this, it has been seen convenient to carry out the survey technique, whose questionnaire has been directed towards the legal operators in order to know their impressions on the subject to be investigated, having as a main result that the criminal norm that regulates psychological violence has problems of structuring and therefore of interpretation, which generates impunity in these types of cases. Finally, as a relevant conclusion, it has been reached that there are structural deficiencies in the criminal law, lack of training of the legal operators, generating unity of criteria and that the psychological expertise issued by the specialists does not meet the parameters established for a timely pronouncement and effective.
