Asamblea constituyente y reforma total de la Constitución Política del Perú de 1993

Abstract

El propósito de la presente investigación es indagar sobre los mecanismos que el ordenamiento jurídico peruano contempla para la convocatoria a una Asamblea Constituyente, órgano colegiado esencial para el proceso de discusión, deliberación y creación de un nuevo texto constitucional. Bajo este escenario, se mantiene en la línea estrictamente académica, para presentar, a través de un análisis dogmático las diferentes posibilidades de generar la apertura del proceso constituyente. El método empleado es de enfoque cualitativo, tipo básico, diseño investigación-acción y el alcance es exploratorio explicativo. Al término de la investigación, se ha caído en cuenta que sí es posible viabilizar la convocatoria a una Asamblea Constituyente, existiendo tres posibles vías. Así, como principal conclusión, se ha rescatado que para proceder a activar el poder constituyente originario no hace falta reformar la Constitución de manera previa.

The purpose of this research is to investigate the mechanisms that the Peruvian legal system contemplates for the convocation of a Constituent Assembly, an essential collegiate body for the process of discussion, deliberation and creation of a new constitutional text. Under this scenario, the strictly academic line is maintained, to present, through a dogmatic analysis, the different possibilities of generating the opening of the constituent process. The method used is of a qualitative approach, basic type, action-research design and the scope is exploratory-explanatory. At the end of the investigation, it has been realized that it is possible to make the convocation of a Constituent Assembly viable, there are three possible ways. Thus, as the main conclusion, it has been rescued that in order to activate the original constituent power, it is not necessary to reform the Constitution in advance.
