El rol del Juzgado de Investigación Preparatoria frente al delito de omisión a la asistencia familiar en aras de salvaguardar el interés superior del niño en sede Sol La Molina en el año 2019

Abstract

La presente tesis trata sobre “ El rol de Juzgado de Investigación Preparatoria frente al delito de omisión a la asistencia familiar en aras de salvaguardar el interés superior del niño en sede sol la Molina durante el año 2019”, materia que se encuentra enmarcado en la rama del derecho de Familia y Penal, el cual tiene como propósito demostrar y/o determinar la función que tiene el Poder Judicial sobre la omisión a la asistencia familiar en aras de salvaguardar el interés superior del niño alimentista del incumplimiento del imputado, durante el año 2019 en la competencia del Juzgado de Investigación Preparatoria de la Molina. La investigación presentada se desarrolló mediante el enfoque cualitativo ya que se busca demostrar como el Juzgado de Investigación Preparatoria cumple o incumple su rol frente al delito de omisión a la asistencia familiar en aras de salvaguardar el interés superior del niño en la sede sol del Distrito de la Molina durante el año 2019, el tipo de investigación que se utilizo fue tipo no experimental, dado que se condiciono el tema a salvaguardar el interés superior del niño y cómo el estado mediante los órganos jurisdiccionales cumplen su rol en la protección del niño, adolescente alimentista, finalmente el diseño que se utilizó es Teoría Fundamentada, el objetivo de la presente investigación es demostrar si el Poder Judicial mediante el Juzgado de Investigación preparatoria cumplió o incumplió su rol frente al delito de omisión a la asistencia familiar en aras de salvaguardar el interés superior del niño en sede sol del distrito de La Molina durante el año 2019.

The research presented was developed through a qualitative approach since it seeks to demonstrate how the Preparatory Investigation Court fulfills or fails to fulfill its role against the crime of omission of family assistance in order to safeguard the best interests of the child in the headquarters of the District of La Molina during 2019, the type of research that was used was non-experimental, since the subject was conditioned to safeguard the best interests of the child and how the state through the jurisdictional bodies fulfill their role in the protection of the child, adolescent obligee, finally the design that was used is Grounded Theory, the objective of this investigation is to demonstrate whether the Judicial Power, through the preparatory Investigation Court, fulfilled or failed to fulfill its role against the crime of omission of family assistance in order to safeguard the interest Superior of the child in the Sun headquarters of the La Molina district during the year 2019.
