Uso de la bioestadística ante eventos de alto riesgo sanitario y el derecho a la intimidad en el Perú 2020 – 2021

Abstract

La presente tesis busco analizar de qué modo el uso de la bioestadística ante eventos de alto riesgo sanitario afecto el derecho a la intimidad en el Perú con la aparición del COVID 19 en el periodo 2020-2021. Desde una perspectiva del Derecho Constitucional aplicado en Perú y el extranjero. Por ello, es de relevancia realizar una investigación básica o pura, cuya finalidad es indagar sobre un tema en contraste con las bases teóricas; y cuyo enfoque es cualitativo, ya que se obtiene registros narrativos de los fenómenos, objeto de estudio recopilando datos por medio de las entrevistas que se llevó a cabo a profesionales del derecho. Donde se comprobó la vulneración al derecho a la intimidad con el mal uso y la falta de regulación de la bioestadística ante la crisis sanitaria en el Perú. Permitiendo analizar las medidas adoptadas en materia de protección de datos personales y el derecho a la intimidad en el Estado Peruano y en países como España, Colombia y Venezuela. En síntesis, el mundo se enfrenta a una crisis sanitaria que ha generado el impulso de la creación de una ley que regule el uso de la bioestadística del ámbito sanitario de alto riesgo.

This thesis seeks to analyze how the use of biostatistics in the event of high health risk events affected the right to privacy in Peru with the appearance of COVID 19 in the period 2020-2021. From a perspective of Constitutional Law applied in Peru and abroad. For this reason, it is important to carry out basic or pure research, the purpose of which is to inquire about a topic in contrast to the theoretical bases; and whose approach is qualitative, since narrative records of the phenomena are obtained, object of study by collecting data through interviews carried out with legal professionals. Where the violation of the right to privacy with the misuse and lack of regulation of biostatistics was verified in the face of the health crisis in Peru. Allowing to analyze the measures adopted regarding the protection of personal data and the right to privacy in the Peruvian State and in countries such as Spain, Colombia, and Venezuela. In short, the world is facing a health crisis that has generated the impetus for the creation of a law that regulates the use of biostatistics in the high-risk health field.
