La importancia de la protección del emplatado en las creaciones gastronómicas dentro de los derechos de autor

Abstract

La presente investigación tiene como objetivo dar a conocer la “Importancia de la protección del emplatado en las creaciones gastronómicas dentro de los derechos de autor”. En vista de que no existe una protección legal del emplatado, por ende, tampoco existe un reconocimiento hacia los autores de las creaciones gastronómicas, específicamente a los creadores de la cocina de autor y cocina molecular; En ese sentido, debe regularse en el artículo 5 de la Ley de Derechos de Autor - Decreto Legislativo N°822 y sus Modificaciones, así como en la lista de obras protegidas que está regulada por la Organización Mundial de la Propiedad Intelectual – OMPI.

The objective of the present research is to make known the "Importance of the protection of the plating in the gastronomic creations within the copyright". As there is no legal protection for plating, the authors of gastronomic creations, specifically the creators of signature cuisine and molecular cuisine, are not recognized; In this sense, it must be regulated in Article 5 of the Copyright Law - Legislative Decree No. 822 and its Amendments, as well as in the list of protected works regulated by the World Intellectual Property Organization - WIPO.

In addition, it is important to highlight that the protection of the plating in gastronomic creations would only be given to those works that comply with the originality requirement.

In accordance with the above, several studies on gastronomic creations were searched, so it was concluded the importance of plating in gastronomic creations within the framework of the Peruvian Copyright Law, with the purpose that the authors are duly protected by the law.
