Derecho a la educación de los estudiantes y la libertad de empresa en el marco del servicio educativo privado en Carabayllo, 2016-2021

Abstract

La investigación tuvo como objetivo general determinar si el Derecho a la Educación de los estudiantes afectan el Derecho a la Libertad de Empresa en el marco del servicio educativo privado en Carabayllo, 2016-2021,para lo cual se empleó una metodología de enfoque cualitativo, tipo exploratoria, transversal, aplicando el método de interpretación de la norma jurídica ratio legis, con un muestreo no probabilístico dirigido, empleando la entrevista estructurada a cuatro (4) Instituciones Educativas del distrito de Carabayllo, Lima. Los resultados determinaron que la Ley N°27665 motiva el incumplimiento del pago de pensiones generando morosidad, afectando el Derecho a la Libre Empresa y dificultando el pago de planillas y otras obligaciones en la Instituciones Educativas, al prohibirse poder establecer mecanismos de cobranza como la suspensión del servicio educativo, no atención de reclamos de los padres de familia y al existir leyes de Protección al Consumidor. Todo esto indica que las leyes que protegen el Derecho de la Educación de los estudiantes y al Consumidor están siendo más ventajosas que el Derecho a la Libertad de Empresa.

The general objective of the research was to determine if the Right to Education of students affects the Right to Freedom of Enterprise in the framework of the private educational service in Carabayllo, 2016-2021, for which a qualitative approach methodology was used, type exploratory, cross-sectional, applying the method of interpretation of the legal rule ratio legis, with a non-probabilistic sampling directed, using the structured interview to four (4) Educational Institutions of the district of Carabayllo, Lima. The results determined that Law No. 27665 motivates non-compliance with the payment of pensions, generating delinquency, affecting the Right to Free Enterprise, and making it difficult to pay payroll and other obligations in Educational Institutions, by prohibiting the establishment of collection mechanisms such as suspension. of the educational service, non-attention to complaints from parents and the existence of Consumer Protection laws. All this indicates that the laws protecting the Right to Education for students and the Consumer are re advantageous than the Right to Free Business.
