Problemática en la ejecución de la tenencia compartida durante la pandemia de COVID-19 en Lima, 2020-2021

Abstract

La presente investigación tiene como propósito determinar la problemática en la ejecución de la tenencia compartida durante la pandemia de Covid-19 en lima, 2020-2021. Por ello la presente investigación tiene como objetivo analizar cómo se protegió el derecho del menor a una relación familiar en la ejecución de la tenencia compartida en lima, 2020-2021. Para tal fin se utilizó una investigación con enfoque cualitativo, de tipo básico y diseño de teoría fundamentada. Se halló que para la tenencia compartida es importante que los padres puedan realizar diversas coordinaciones mutuas por el bienestar de su menor, además de contar con el apoyo del equipo multidisciplinario para cuidar el bienestar del niño. Asimismo, dentro de la tenencia compartida se encuentra limitada al interés superior del niño; es decir, ningún argumento que intente proteger el derecho a la relación con la familia será válido si dicha relación causa un malestar en el menor. Teniendo en cuenta que el derecho a la salud mental y psicológica es superior al derecho de la relación familiar, las autoridades y las partes deberán realizar las visitas de modo que el niño no se infecte con el covid-19, en estos casos hubo protocolos para el distanciamiento social y medios electrónicos que pueden usarse. En consecuencia, se concluyó que se protege el derecho al menor a una relación familiar en la ejecución de la tenencia compartida en la ciudad de lima, 2020, ya que ambos padres y sus familias mantienen contacto con el menor, sin embargo, debido a la pandemia Covid-19 se debe tomar ciertas precauciones para que el menor no se vea contagiado por el virus.

The purpose of this research is to determine the problems in the execution of shared tenure during the Covid-19 pandemic in Lima, 2020-2021. Therefore, this research aims to analyzehow the child's right to a family relationship was protected in the execution of shared custody in Lima, 2020-2021. For this purpose, research with qualitative emphasis, basic type and grounded theory design was used. It was found that for shared custody it is important that parents can make various mutual arrangements for the well-being of their child, in addition to having the support of the multidisciplinary team to take care of the well-being of the child. Likewise, within shared custody is limited to the best interests of the child; That is, no argument that seeks to protect the right to a relationship with the family will be valid if that relationship causes discomfort to the child. Bearing in mind that the right to mental and psychological health is superior to the right of the family relationship, the authorities and the parties must carry out visits so that the child is not infected with the child, in these cases there are protocols for social distancing and electronic means that can be used. Consequently, it was concluded that the right of the child to a family relationship is protected in the execution of shared custody in the city of Lima, 2020, since both parents and their families maintain contact with the minor, however, due to the Covid-19 pandemic, certain precautions must be taken so that the minor is not infected by the virus.
