Propuesta normativa para establecer la unión civil de parejas del mismo sexo (Perú-2022)

Abstract

El presente estudio titulado “Propuesta Normativa Para Establecer La Unión Civil De Parejas Del Mismo Sexo (Peru-2022)”, siendo una investigación de tipo básica, con diseño descriptivo, de enfoque cualitativo; teniendo como variables los motivos del rechazo de las propuestas, sus efectos en la sociedad peruana, el incentivo por lo cual se debe aprobar, la forma en que se debería dar. Su objetivo general es describir la importancia de regular la Unión Civil del mismo sexo en el Perú, planteándose como hipótesis la necesidad de implementar y las ventajas que traería; teniendo como población la propuesta de Unión Civil del mismo sexo, las muestra son los países de Latinoamérica Hispanohablantes que regulen la Unión Civil y/o modelos similares para parejas del mismo sexo; se utilizó técnicas de análisis documental y de legislación comparada. Determinando como conclusión que la Unión Civil de parejas del mismo sexo tiene su importancia en el respeto de diversos derechos como: derechos patrimoniales, derecho a la salud, derecho de igualdad ante la ley, derechos familiares, derecho al nombre, etc.

The present study entitled "Regulatory Proposal to Establish the Civil Union of Same-Sex Couples (Peru-2022)", being a basic type of research, with a descriptive design, with a qualitative approach; having as variables the reasons for the rejection of the proposals, its effects on Peruvian society, the incentive for which it should be approved, the way in which it should be given. It´s general objective is to describe the importance of regulating the same-sex Civil Union in Peru, hypothesizing the need to implement it and the advantages it would bring; Taking the same-sex Civil Union proposal as a population, the samples are the Spanish-speaking Latin American countries that regulate the Civil Union and/or similar models for same-sex couples; techniques of documentary analysis and comparative legislation were used. Determining as a conclusion that the Civil Union of same-sex couples is important in respect of various rights such as: property rights, right to health, right to equality before the law, family rights, right to a name, etc.
