dc.description.abstract | RESUMEN
Entre los delitos que regula el Código Penal, están los “Delitos de Peligro”, pero el que interesa a
la investigación es el Delito de Conducción en Estado de Ebriedad que está dentro de los delitos
de peligro abstracto, estos no mencionan los bienes jurídicos protegidos en el tipo penal, ya que la
conducta que se realiza es estadística o general para ser capaz de producir lesiones.
Ahora bien, la ley penal acumula un doble objeto a la hora de llevarse a cabo un proceso, pues el
artículo 92º del Código Penal instaura que junto con la pena se establece la reparación civil,
debiendo tener en cuenta que, si bien ambas se unifican en el proceso penal, esto no implica que
tengan la misma naturaleza. La reparación civil en el proceso penal no es otra cosa que la
responsabilidad civil atribuida al sujeto autor del ilícito penal, por lo cual ambas deben tener el
mismo fin: reparar integralmente el daño irrogado. Esto se ve reforzado por el propio Código Penal
que establece en el artículo 93° la extensión de la reparación, extensión que está inmersa dentro
de la figura de la responsabilidad civil.
Por ello, los objetivos perseguidos en la presente investigación fueron determinar el fundamento
jurídico por el que no debe imponerse reparación civil en el Delito de Conducción en Estado de
Ebriedad, y determinar los criterios que los jueces penales unipersonales de la ciudad de
Cajamarca usaron para aprobar las sentencias conformadas en relación a la reparación civil en el
Delito de Conducción en Estado de Ebriedad, cuando no existe daño ocasionado por este delito.
De esta manera, dado que la reparación civil no puede configurar bajo ningún supuesto una
sanción jurídico penal, ya que se sustenta en un interés particular, tiene naturaleza distinta de la
pena y por ningún motivo puede cumplir las funciones de ésta, pues la reparación civil derivada del
delito se centra en la función de reparar el daño producido a la víctima por la acción delictiva,
además, para la fijación del monto de reparación civil se debe tomar en cuenta las disposiciones
del Código Civil, es claro que en esta clase de delitos no debe imponerse un monto a causa de
reparación civil, ya que no hay ningún daño objetivo que deba ser reparado, incluso las mismas
sentencias condenatorias conformadas muestran esto, ya que no hay una clara motivación
respecto a reparación civil, pues los únicos fundamentos que se aprecian son los artículos 92º y
93º del Código Penal y los fundamentos jurídicos 9 y 10 del Acuerdo Plenario Nº 06-2006/CJ-116,
que no son criterios suficientes, pues no desglosan cada uno de los requisitos que deben de
configurarse para la imposición de esta figura. | es_PE |
