La responsabilidad civil de empresas que brindan el servicio de tirolesa en la ciudad del Cusco en el 2015- 2018

Abstract

El turismo de aventura, especialmente la modalidad de tirolesa es considerada como un turismo riesgoso, el mismo que es brindado por diversas empresas turísticas en la ciudad de Cusco, siguiendo aparentemente lo establecido en el Decreto Supremo N° 005-2016-MINCETUR. En los últimos años hemos sido testigos de los diversos accidentes ocurridos al momento de practicar este turismo de aventura. Sin embargo, en la actualidad no existe un criterio legal sobre la atribución de la responsabilidad civil de las empresas ante cualquier siniestro, sobre todo cuando las empresas turísticas se respaldan en la asunción de riesgo firmando un contrato de liberación de responsabilidad antes de brindar el servicio. Es por ello que, esta investigación analiza la regulación del turismo de aventura, a través de opiniones de expertos y doctrina, demostrando que este Decreto Supremo incide de manera negativa, puesto que, su regulación no está orientada a proteger al turista y su seguridad al momento de practicar este turismo de aventura.

The adventure tourism, specially the zip line modality is considered as a risky tourism, the same that is offered by diverse tourist companies in the city of Cusco, following seemingly the stablished in the Supreme Decree N° 005-2016-MINCETUR. In recent years we’ve been witnesses of various accidents occurred at the moment of practicing this adventure tourism. However, nowadays there is no legal criteria on the attribution of the civil liability of companies in the presence of any accident, particularly when the touristic companies are supported on the assumption of risk signing a release contract of responsibility before providing the service. For this reason, this research analyzes the regulation of the adventure tourism, through experts’ opinions and doctrine, demonstrating that this Supreme Decree has a negative influence, given that its regulation is not orientated to protect the tourist and his safety at the moment of practicing this adventure tourism.
