El incumplimiento del vendedor en los contratos internacionales de compraventa de mercaderías y su responsabilidad por el daño ocasionado

Abstract

El propósito del presente trabajo es dar a conocer las obligaciones que tiene el vendedor en los contratos internacionales de compraventa de mercadería, la responsabilidad que tiene este frente al comprador cuando por su descuido o negligencia genera algún tipo de incumplimiento, las cuales también se detallarán, todo ello, bajo el método explicativo el cual está orientado a la comprensión; asimismo, se descubrieron cuáles son las medidas o mecanismos de defensa que tiene el comprador cuando ocurran este tipo de inconvenientes, como manejarlo, que exigir, los derechos que este adquiere y como solucionar este tipo de situaciones para que no se vea perjudicado y por último se concluyó, que al incumplir con las obligaciones pactadas en el contrato o las obligaciones derivadas de la convención estas serían las causales de incumplimiento por parte del vendedor y por ende, responder por el daño ocasionado.

The purpose of this paper is to publicize the obligations that the seller has in international contracts for the sale of merchandise, the responsibility that this has against the buyer when due to his carelessness or negligence he generates some type of breach, which will also be detailed, all this, under the explanatory method which is oriented to understanding; Likewise, it was discovered what are the defense measures or mechanisms that the buyer has when this type of inconvenience occurs, how to handle it, what to demand, the rights it acquires and how to solve this type of situation so that it is not harmed and finally It was concluded that by not complying with the obligations agreed in the contract or the obligations derived from the convention, these would be the causes of non-compliance by the seller and therefore, respond for the damage caused.
